1. Acceptance of Terms
By accessing or using our website, submitting information through a form, booking a call, communicating with us, or purchasing services from Dirt Cheap Agency LLC, you agree to be bound by these Terms. If you do not agree, do not use the website or services.
If you are using our website or services on behalf of a business, you represent that you have authority to accept these Terms on behalf of that business.
2. Services Provided
Dirt Cheap Agency LLC provides paid Facebook and Instagram advertising management and related support for service-based businesses. Services may include Meta campaign setup, ad creative, ad copy, campaign launch, campaign management, ongoing optimization, weekly performance snapshots, lead generation support, reporting, and client communication. Landing pages, funnels, websites, CRM setup, and advanced automations are not included in the base service unless separately agreed in writing.
The exact scope, pricing, timeline, deliverables, start dates, billing terms, platform-specific commitments, and support terms may be described on our website, in a written agreement, invoice, checkout page, proposal, onboarding form, or other written communication between you and Dirt Cheap Agency LLC. If a separate written agreement conflicts with these Terms, the separate written agreement controls for that specific engagement.
3. No Guarantee of Results
Advertising results vary. We do not guarantee specific leads, sales, appointments, revenue, conversion rates, return on ad spend, cost per lead, approval by advertising platforms, campaign performance, or business outcomes.
Results may depend on your market, offer, pricing, competition, budget, creative, website or landing page performance, follow-up speed, sales process, reviews, seasonality, platform changes, and other factors outside our control.
4. Ad Spend Is Separate
Unless specifically stated in writing, advertising spend is separate from Dirt Cheap Agency service fees. You are responsible for paying advertising platforms directly, including Meta, Facebook, Instagram, or any other advertising platform used for your campaigns.
We may recommend an advertising budget, but you are responsible for approving and funding ad spend. Platform charges, rejected payments, billing holds, ad account restrictions, and platform-level fees are your responsibility.
5. Client Responsibilities
To allow us to provide services, you agree to provide accurate information, timely access, and reasonable cooperation. Your responsibilities may include:
- Providing accurate business, offer, service area, and contact information
- Providing access to ad accounts, pages, pixels, and any other tools or assets required for the services included in your specific engagement
- Reviewing and approving campaign materials when requested
- Maintaining sufficient ad spend and valid payment methods with advertising platforms
- Following up with leads promptly and professionally
- Complying with applicable laws, platform policies, industry rules, and advertising requirements
- Ensuring claims about your business, pricing, services, licenses, results, and offers are accurate and substantiated
6. Payments, Billing, and Cancellations
You agree to pay all fees described in your checkout page, invoice, service agreement, or other written communication with Dirt Cheap Agency LLC. Fees are generally for service work and management support, not for ad spend.
Unless a different written agreement applies, recurring services may renew automatically according to the billing cycle selected or agreed to. You are responsible for keeping payment information current.
Cancellation terms, refund terms, and notice periods are governed by the specific agreement, checkout terms, invoice, or written terms you accepted. If no separate written cancellation term applies, contact us at [email protected] to request cancellation before your next billing cycle.
We may pause or terminate services for failed payments, chargebacks, non-cooperation, policy violations, unlawful activity, abusive communication, or other conduct that prevents us from reasonably providing services.
7. Intellectual Property
The Dirt Cheap Agency website, branding, layout, design, copy, graphics, systems, processes, templates, reports, and other materials we create or provide are owned by Dirt Cheap Agency LLC or used with permission, unless otherwise stated.
You retain ownership of your business name, logos, trademarks, images, testimonials, customer lists, account data, and materials you provide to us. You grant us permission to use those materials as needed to provide services.
Unless otherwise agreed in writing, you may not copy, resell, publish, distribute, or reuse our internal systems, templates, strategies, website designs, reporting formats, or service materials outside your own business use.
8. Website Use
You agree not to misuse the website, attempt to interfere with its operation, access systems without authorization, submit false or misleading information, copy content for improper use, or use the website for unlawful purposes.
We may update, remove, restrict, or discontinue parts of the website at any time without notice.
9. Form Submissions and Communication Consent
When you submit a form on our website, you may provide information such as your full name, business name, phone number, email address, website URL, and monthly ad budget. You agree that the information you provide is accurate and that we may use it to respond to your inquiry, evaluate your business, and communicate with you about our services.
Our forms may include optional consent choices for calls, SMS messages, and marketing or promotional communications. Consent choices are separate from submitting the form. Consent to SMS is not required as a condition of purchase.
10. Calls, SMS, and Email Communications

No sharing of SMS opt-in data for marketing
We do not share or sell SMS consent or opt-in data with third parties for marketing or promotional purposes. Please review our Privacy Policy for more information about how mobile opt-in information is handled.
11. Privacy Policy
Our Privacy Policy explains how we collect, use, retain, and share information, including information submitted through forms and mobile opt-in data. Please review it here: Privacy Policy.
The Privacy Policy includes details about SMS opt-in data and explains that mobile opt-in information is not sold, shared, or transferred to third parties for marketing or promotional purposes.
12. Third-Party Platforms and Tools
Our services may depend on third-party platforms and tools such as Meta, Facebook, Instagram, CRMs, analytics tools, tracking pixels, landing page platforms, phone and SMS providers, email systems, scheduling tools, hosting providers, and payment processors.
We do not control third-party platforms, their rules, algorithms, outages, policy decisions, account reviews, billing systems, or approval processes. Your use of those platforms may be subject to separate terms and policies from those providers.
13. Limitation of Liability
To the fullest extent permitted by law, Dirt Cheap Agency LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, advertising losses, or business interruption.
To the fullest extent permitted by law, our total liability for any claim related to the website or services will not exceed the amount you paid to Dirt Cheap Agency LLC for the specific service giving rise to the claim during the three months before the event giving rise to the claim.
14. Disclaimer of Warranties
The website and services are provided on an “as is” and “as available” basis. We disclaim warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the website or services will be uninterrupted, error-free, secure, profitable, or free from defects, platform issues, or third-party interruptions.
15. Indemnification
You agree to indemnify and hold harmless Dirt Cheap Agency LLC, its owners, team members, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising out of your business, your materials, your offers, your use of our services, your violation of these Terms, your violation of law, or your violation of third-party rights or platform policies.
16. Termination
We may suspend or terminate access to the website or services if you violate these Terms, fail to pay, provide false information, misuse the services, violate platform policies, engage in unlawful conduct, or interfere with our ability to provide services.
Termination does not affect payment obligations, limitations of liability, intellectual property rights, confidentiality obligations, or any terms that by their nature should survive termination.
17. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining sections will continue in full force and effect.
